On July 13th 2016 The ATF Rule 41F Goes Into Effect
In order to understand it's important I explain some key things about What a Gun Trust is For and how Gun Trusts are Now Changing for the worse.
At the end of the day it comes down to the idea that our current administration has figured out a way they can register gun owners and their guns without working through congress to change any laws.
The first thing you need to understand is that when you die the government is going to collect all your guns and other property and appoint someone in the court system to manage your possessions and the distribution of your inheritance. The process is called Probate and it has these significant and awful effects:
  •  1. All your guns and possessions become public record... via the court system to be forever accessible for the government to know what you owned and who inherited what
  •  2. You have to pay the government for their time to administer this process and it comes out of your assets...
  •  3. The process takes months to years which will delay your family from getting their hands on any of the inheritance including the guns
If you think that having a WILL can stop this process you are wrong... A Will does NOT prevent Probate... it just generally shortens the process and saves a little money
THINK ABOUT IT. IN A SINGLE GENERATION THE GOVERNMENT WOULD HAVE A RECORD OF EVERY FIREARM AND IT'S OWNER WITHOUT CHANGING ANY LAWS.
THE ONLY LOOPHOLE TO AVOID THIS PROCESS IS TO HAVE A TRUST

You have probably heard of Gun Trusts before but didn't understand why you needed one. But now Rule 41F has moved up your time table and the time to get a Gun Trust is NOW.
SO WHAT IS CHANGING?
Here is what is changing... if you setup your Gun Trust AFTER July 13th 2016 then anyone you name as a trustee will have to get licensed with the ATF in order to handle any of your NFA guns.

Setup Your Trust Before July 13th 2016 and that isn't required

The process is a little confusing and can be complicated. People hire attorneys just to understand how it all works... and then there is the actual cost of setting up the trust.
